Pass — Estate Planning

So what you built can pass the way you intend

We prepare wills, revocable trusts, special needs trusts, gift and estate tax planning, and business succession plans. Each plan is designed so your assets pass the way you intend, with less court involvement.

Wills and revocable trusts – A will names who receives your property and who will handle your estate. A revocable trust can hold assets during your life and direct them after you are gone, often with less court involvement than a will alone. Many plans use both, along with documents that name who can make decisions if you cannot. More on this site: wills and trusts, Colorado trusts, and Colorado estate planning.

Special needs trusts – A special needs trust can hold assets for a person with a disability so those assets are not automatically treated as available for needs-based public benefits. A trustee can use the trust to support that person’s day-to-day life while following the benefit rules. More on this site: Colorado special needs trusts.

Gift and estate tax – Some families need a plan for gift and estate tax, not only a list of who receives property. We include gift and estate tax planning in the overall plan, and we prepare gift tax returns and estate tax returns when a filing is required. More on this site: gift tax returns and estate tax returns.

Business succession – If you own a business, the estate plan has to say what happens to that company. Succession planning covers who can take over, how an interest is bought or transferred, and how that lines up with the operating agreement and with the will or trust.
